  1. PARTIES

This Distance Sales Agreement (“Agreement”) is entered into between:

Buyer:
Any real or legal person who registers on the Outfound platform and accepts this Agreement electronically.

  1. SUBJECT OF THE AGREEMENT

The subject of this Agreement is to define the rights and obligations of the parties regarding the sale and provision of digital services (subscription-based access, credit-based usage, software access, etc.) offered through the Outfound (“Platform”).

  1. SERVICE DESCRIPTION

• The service is a non-physical, fully digital software service (SaaS – Software as a Service).
• The service includes B2B lead generation, data enrichment, analytics, and similar digital functionalities.
• Access to the service is provided electronically immediately after payment confirmation.
• No physical delivery is involved.

  1. PRICING AND PAYMENT

• Service fees are clearly displayed on the Platform.
• Payments are securely processed via the iyzico payment infrastructure.
• Payments may be made by credit card or other payment methods supported by iyzico.
• Access to the service is not granted until payment is successfully completed.

  1. SERVICE DELIVERY

• Digital services are activated immediately after successful payment.
• The service is deemed delivered once the user account is activated.
• The Buyer is responsible for ensuring that their internet connection and technical infrastructure are sufficient to use the service.

  1. RIGHT OF WITHDRAWAL AND EXCEPTION

Pursuant to Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation:

• For digital content and services performed instantly in electronic form, the right of withdrawal does not apply once service performance has begun.
• By completing the payment and gaining access to the service, the Buyer expressly acknowledges and accepts that they waive their right of withdrawal.

  1. REFUND POLICY

• No refunds are issued for digital services once service performance has begun.
• In the event that the service cannot be provided at all due to a technical issue caused by the Seller, a refund may be issued following an internal review.

  1. GOVERNING LAW AND JURISDICTION

Any disputes arising out of or in connection with this Agreement shall be subject to the jurisdiction of the Courts and Enforcement Offices of İzmir, Turkey.

  1. EFFECTIVE DATE

By completing the payment on the Platform, the Buyer confirms that they have read, understood, and accepted this Distance Sales Agreement electronically.


DELIVERY AND REFUND POLICY

  1. DELIVERY

All services provided by Outfound are digital and non-physical.

• Delivery is performed electronically immediately after successful payment.
• The service is considered delivered once the user account is activated.
• No physical shipment is made.

  1. CANCELLATION AND REFUNDS

• For digital services, refunds are not available once service performance has begun.
• By completing the purchase, the user acknowledges and accepts this condition.
• Subscription cancellations stop future billing cycles only; no refunds are issued for past usage periods.

  1. TECHNICAL ISSUES

• If the service cannot be provided at all due to a technical failure attributable to the Seller, the issue will be reviewed and a refund may be issued if deemed appropriate.
• User-side technical or connectivity issues do not qualify for refunds.
