Is it legal to send cold email to companies in Türkiye?

Commercial messages can go to merchants and tradespeople without prior consent, but İYS registration, opt-out checks and a 3-business-day opt-out apply.

Under Turkish Law No. 6563 on E-Commerce, commercial electronic messages generally need the recipient's consent; merchants and tradespeople are the exception, so promotional email can be sent to them without prior consent. Sending to individual consumers requires consent.

Not needing consent does not lift the other rules:

  • As the sender, you must be registered in the Commercial Message Management System (İYS) and check whether the recipient has an opt-out record there.
  • Every message must show your identity, your contact details and an easy way to opt out.
  • You must stop sending within 3 business days of receiving an opt-out.
  • Personal business addresses such as firstname.lastname@company are personal data; under KVKK the person must be informed, including where the data came from.
